Use of this website

This website (the “Website”) is owned and operated by Deacon & Son (Swindon) Limited (“Deacons”). Your use of and access to the Website is subject to these Terms and Conditions (including the Privacy Policy). If you breach any of these Terms and Conditions, your permission to use and access the Website will automatically terminate.

All material published on the Website is provided “as is” and that, to the fullest extent permissible by law, Deacons makes no representation or warranty (whether express or implied) in respect of such material and specifically makes no representation or warranty that the operation of the Website will be uninterrupted and/or error free, that defects will be corrected, or that the Website (or the server that makes it available) will be free of viruses or bugs.

The Website is for use only by residents of the UK, aged 18 and over.

Your Order

Deacons will acknowledge any order made by you through the Website [by email or such other method as we deem appropriate] but this will not constitute acceptance of your order.

All orders made by you through the Website are subject to acceptance by Deacons who may choose not to accept any order, for any reason, including unavailability of goods. For the avoidance of doubt, no contract will exist between you and Deacons for the sale by Deacons to you of any product unless and until Deacons sends you an e-mail confirming that it has accepted your order and dispatched your product. Your order will be given a consignment number which you can track by clicking on www.fedex.com/ukservices

All contracts between you and Deacons will be made in English.

Details of all orders received from you will be kept by Deacons and will be available on request by you. You may correct and/or amend your order at any time [by contacting us on the details below] up to acceptance by Deacons.
Images of goods on the Website are not to scale. Unless stated otherwise, all weights and measurements are approximate. All colours displayed on the Website are approximate and are as accurate as electronic processes allow. Prices and specifications of goods are correct at the time of uploading information to the Website. Deacons reserves the right to update prices and specifications as appropriate without prior notice.

Delivery

Once your order has been accepted, Deacons will arrange delivery of the goods in accordance with the delivery details provided by you. Delivery will be made by Fedex UK Ltd special delivery requiring a signature on delivery. Please allow at least 3 working days from acceptance of your order for delivery. Please note that we can only deliver to UK addresses.

Postal charges are £5.95 for next-day delivery (Monday - Fridays) or £3.95 for 3-5 working days delivery. Delivery is free for orders over £150.

Orders must be received before 12 midday GMT to be eligible for next-day delivery.
Returns Policy

You may return goods either because:

  • they are damaged, defective or incorrect. If this is the case, Deacons will refund the delivery charges incurred in sending the item to you and pay your costs of returning it to Deacons. In the event that no fault is found with the goods, Deacons reserves the right to re-charge you for the goods and all fees and expenses incurred; or

  • in accordance with your right under EU law to return them within 7 days of delivery. Where you exercise this right, Deacons will refund the cost of the goods and the cost of sending the goods to you but not your costs of returning the goods.

You may also return any goods to us for any reason within 30 days of delivery, providing the goods are undamaged and in their original packaging, and provided the goods are returned to us by Royal Mail special delivery requiring a signature on delivery. We will examine all goods returned in this way and reserve the right to charge you for the goods if this condition is not complied with.

Deacons reserves the right to defer the date of delivery or to cancel your order if it is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control, including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to either party's workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of goods, provided that, if the event in question continues for a continuous period in excess of 21 days, you will be entitled to give notice in writing to Deacons to cancel your order.

General

Nothing in these Terms and Conditions affects your statutory rights as a consumer.

Deacons complies with the Data Protection Act and will not pass on your details to any third party without your prior consent. Any personal details you submit via the Website will be collected and used by Deacons in accordance with the Privacy Policy. Any payment details you submit via the Website will be collected and used by PayPal only and will not be passed to any other party, including Deacons.

Any material found within the Website, including text or images, may not be copied, distributed or downloaded in any way except for your own personal non-commercial use or as permitted by the Copyright, Designs and Patents Act 1988. You hereby agree not to copy, adapt, alter or create any derivative work from any of the material contained in the Website. You hereby agree to keep all copyright, trade mark other proprietary notices intact.

  • losses that were not caused by any breach on Deacons’ part; and/or

  • indirect and/or consequential losses, losses of profit, losses of opportunity, business losses; and/or

  • losses to non-consumers; and/or

  • losses arising out of Deacons’ negligence;

but nothing in these Terms and Conditions or the Website limits (or purports to limit) Deacon’s liability for death or personal injury resulting from negligence.
